Price Back Guarantee. Arrowquip is committed to improving the business and safety of cattle handling. Arrowquip’s Price Back Guarantee detailed in this document exhibits this commitment to safety.

In the event that a purchaser of Arrowquip equipment suffers a physical injury in the operation of the equipment, Arrowquip will provide a refund of the equipment purchase price. The term “physical injury” means a physical injury or ailment that requires medical treatment and prevents an operator from fulfilling day-to-day operations (“Injury”).

Arrowquip also commits to repair or replace any part of the equipment that is defective, malfunctions or otherwise falls under normal use and inside the equipment’s warranty terms. If the equipment requires replacement, it shall be replaced with an identical model or a newer model of the equipment.

Applicability/Items Outside Guarantee. Arrowquip offers this Price Back Guarantee to all customers that: (i) have purchased Arrowquip equipment from an authorised Arrowquip dealer after March 31, 2022; (ii) have registered the equipment with Arrowquip’s warranty program within 7 days of purchase; and (iii) operate and maintain their Arrowquip equipment as described in the relevant instructions and manuals.

Each piece of Arrowquip equipment shall be eligible for only one refund under the Price Back Guarantee.

The Price Back Guarantee is solely for the original purchaser of the equipment. The Price Back Guarantee cannot be assigned or transferred.

The Price Back Guarantee shall only apply to purchases of Arrowquip equipment within Canada, the United States of America, the European Union and the United Kingdom.

Except as expressly set forth herein, this Price Back Guarantee does not cover:
i. equipment purchased from unauthorized dealers or from any other party;
ii. The General hydraulic crush;
iii. equipment that has been misused, abused, neglected, or altered for any reason; and
iv. any person(s) who works, represents, or is in any way affiliated with (spouse, relative, sponsored, etc.) any company that manufactures and/or distributes equipment used to manage cattle and/or livestock (a “Competing Cattle Equipment Manufacturer”).

Price Back Guarantee Claim. In order to begin a Price Back Guarantee claim (the “Claim”), you must:
i. Contact Client Care at 1-877-275-6075 or cs@arrowquip.com within seventy-two (72) hours of the occurrence of the Injury.
ii. Provide proof of purchase of the equipment that includes your full name, address, the price of the equipment, and the Arrowquip dealer where the equipment was purchased.
iii. At the sole discretion of Arrowquip, you may be required to provide a certified doctor’s note outlining your Injury.

Investigation. Once you have started your Claim, Arrowquip reserves the right to launch a full investigation into the Claim. An investigation may include any or all of the following:
i. Inspection of the location where the Injury occurred;
ii. Examining the equipment that was in use at the time the Injury occurred;
iii. Taking photographs of the Injury and/or the equipment; and
iv. Questioning any parties that were present at the time of Injury.

Denial of Claim. Arrowquip reserves the right to deny any Claim, at its sole discretion, including in circumstances where:
i. the equipment was not operated and maintained as described in the relevant instructions and manuals;
ii. the equipment was operated by a minor at the time of the Injury;
iii. the equipment was not operated pursuant to the safety procedures outlined in the relevant instructions and manuals;
iv. the Claim is submitted by a Competing Cattle Equipment Manufacturer; or
v. there is failure to comply with any of the terms of this Price Back Guarantee.

Right to Make Design Changes. Arrowquip reserves the right to make changes in the design and other changes in its products at any time and from time to time without notice and without incurring any obligation with respect to any product previously ordered from Arrowquip, sold or shipped by Arrowquip or one of its authorised dealers.

Disclaimer, Limited Liability, and Release. Nothing in this section will limit or exclude liability that cannot be limited or excluded under applicable law.

Arrowquip reserves the right to change, modify, alter, remove or discontinue any or all of the terms herein, at any time, with no prior notice to you.

You understand and agree that to the maximum extent permitted by applicable law, the Price Back Guarantee is the only express guarantee that Arrowquip provides for the equipment, and the above remedy is your sole and exclusive remedy. To the maximum extent permitted by law, Arrowquip expressly disclaims all other warranties and conditions of any kind. including express, implied or statutory with respect to the equipment, including without limitation, any implied warranties of merchantability, fitness for a particular purpose, non-infringement, suitability or any other warranties, representation or conditions that may arise from usage of the equipment.

To the maximum extent permitted by the applicable law, Arrowquip’s obligation shall not extend beyond the obligations expressly undertaken above. Arrowquip’s liability is limited to refund, repair or replace equipment as indicated in this document. Arrowquip and its suppliers, agents, officers, directors, contractors and employees will not be responsible for any other costs, expenses, losses, or inconvenience that you may sustain as a result of the purchase, use, malfunction or defective condition of the equipment.

Arrowquip’s responsibility for any and all losses and damages resulting from any cause whatsoever, including negligence, alleged damage or defective goods, whether such defects are discoverable or latent, shall be limited to the refund, repair or replacement of the equipment as stated above. In no event will Arrowquip be liable for loss of use, loss of profits, loss of opportunity, loss of or damage to livestock, work stoppage, inconvenience, commercial loss, or other incidental or consequential damages whatsoever arising from any claim, including any tort, negligence, gross negligence, willful misconduct or strict liability claim.

You understand and agree that where Arrowquip accepts a claim, Arrowquip does so without their admitting and with Arrowquip actually denying all or any liability, and in accepting the refund you agree that the refund shall not now or at any time hereafter be deemed to be an admission of liability on the part of Arrowquip.

Arrowquip does not authorise any other party, including authorised Arrowquip dealers, to make any representation or promise on behalf of Arrowquip to modify the terms, conditions or limitations of this Price Back Guarantee in any way.
